Agreement to Terms

You further represent that you have the legal authority to enter into a loan agreement and that your use of our services does not violate any applicable law or regulation.
Loan Agreements
Any loan offered through our platform is subject to a separate loan agreement that you will sign electronically or otherwise. The terms and conditions of your individual loan agreement supersede any general terms presented on our website. We reserve the right to decline any application at our sole discretion.
Interest Rates and Fees
Interest rates and fees are disclosed in your loan agreement and on our rates and terms page. All rates and fees are subject to your creditworthiness, state of residence, and other underwriting factors. Payment terms, including any early repayment penalties, will be specified in your loan document.
Prepayment
You may prepay your loan in whole or in part at any time without penalty. Prepayments will be applied to accrued interest and then to principal in accordance with applicable law.
Payment Obligations
You agree to make all loan payments when due in accordance with the terms of your loan agreement. Failure to make payments on time may result in late fees, increased interest rates, and negative reporting to credit bureaus. Repeated delinquency may result in default and collection action.
Use of Platform
You agree to use our website and online banking platform solely for lawful purposes related to obtaining and managing your loan. You may not use our platform to transmit viruses, malware, or any other harmful code. You may not attempt to gain unauthorized access to our systems or engage in any activity that disrupts the function of our services.
Security and Authentication
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We employ industry-standard encryption and security protocols, but we cannot guarantee that our systems are completely impenetrable to all security threats.
Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Lightstream Lending Bank, N.A. or our content providers and is protected by United States and international copyright laws. You may not reproduce, distribute, or transmit any content without our prior written permission.
Disclaimer of Warranties
Our platform is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or inability to access them, even if we have been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Lightstream Lending Bank, N.A. and its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of our services, your loan agreement, or your violation of these terms.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal action or proceeding relating to these terms or your loan agreement shall be brought exclusively in the federal or state courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of such courts.
Dispute Resolution
We encourage you to contact us to resolve any disputes informally. If informal resolution is unsuccessful, you and Lightstream Lending Bank, N.A. agree to submit any disputes to binding arbitration under the American Arbitration Association rules, except that claims under 50 dollars may be pursued in small claims court at your option.
