California Consumer Privacy Act (CCPA) Rights

Your Privacy Rights

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) regarding how we collect, use, and share your personal information. Lightstream Lending Bank, N.A. respects your privacy rights and provides you with the ability to control your information.

Information We Collect and Share

As a regulated financial institution, we collect personal information necessary to provide lending services, comply with legal obligations, and manage accounts. This includes personal identifiers, financial information, employment history, and credit data. Our collection and use practices are governed by banking regulations, the Fair Credit Reporting Act, and applicable privacy laws.

What We Do Not Do

Lightstream Lending Bank, N.A. does not sell personal information as that term is defined under the CCPA. We do not sell your information to third parties for monetary or other valuable consideration. We do not share your personal information with third parties for their independent marketing purposes.

Service Provider Sharing

We share information with service providers who assist in loan origination, account management, payment processing, and technology services. These disclosures are not considered "sales" under the CCPA because our service providers are contractually prohibited from using the information for their own purposes and must comply with our privacy policies.

Your CCPA Rights

Under the California Consumer Privacy Act, you have the right to:

  • Know what information we collect and what we do with it
  • Access the personal information we have collected about you
  • Delete personal information we have collected, subject to certain exceptions
  • Correct inaccurate information we maintain about you
  • Opt out of the sharing of your information with third parties, where permitted

Exercising Your Rights

To exercise your CCPA rights, you may submit a verifiable consumer request by contacting us using the information provided below. We will verify your identity and respond to your request within 45 days. You may submit requests to know, access, correct, or delete your personal information, subject to limitations under the CCPA and our banking obligations.

Verification Process

To verify your identity, we require you to provide identifying information that we can match against information we maintain. We will not charge you a fee for processing your request unless it is excessive, repetitive, or unfounded.

Authorized Agent

If you wish to designate an authorized agent to submit requests on your behalf, you must provide a power of attorney or other proof of authority. Your agent must be able to verify your identity or provide documentation of their authorization.

Financial Institution Exemption

As a national bank regulated by the Office of the Comptroller of the Currency, certain provisions of the CCPA may not apply to our collection and use of personal information that is necessary for credit underwriting and account management. However, we voluntarily provide rights to CCPA-protected categories of information where applicable.

Shine the Light (California Civil Code Section 1798.83)

Under California Civil Code Section 1798.83 (the "Shine the Light" law), customers who are California residents may request information about the categories of personal information we have shared with third parties and the identity of those third parties. To make such a request, please contact us using the information provided below. We will respond within 30 days.

Limiting Use of Information

You have the right to request that we limit our use and disclosure of your personal information to uses necessary to fulfill the purposes for which you provided the information. However, as a regulated financial institution, we must retain and use certain information for compliance with banking regulations, fraud prevention, and loan servicing.

Non-Discrimination

We will not discriminate against you for exercising your CCPA rights. This means we will not deny you goods or services, charge different prices or rates, or provide different levels of quality based on your exercise of CCPA privacy rights. However, we may offer financial incentives, such as discounts or exclusive offers, for the collection or retention of your personal information if permitted by law.

Changes to This Policy

We may update this policy to reflect changes in our practices or applicable law. We will post any material changes to this page and update the effective date. Your continued use of our services following notice of material changes constitutes your acceptance of the updated policy.
